Nestora Terms of Service

Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Nestora websites, portals, mobile applications, and related services (collectively, the "Services") operated by Ingress Technology LLC ("Ingress Technology," "we," "our," or "us"). By accessing or using the Services, you agree to these Terms.

Use of the Services

Nestora is provided for authorized homeowners associations, condominium associations, residential communities, property management companies, residents, guards, administrators, and other approved users. You may use the Services only as authorized by your applicable community and in compliance with these Terms and applicable law.

User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to provide accurate information and promptly update information when necessary.

Dedicated Community Environments

Each customer community operates within its own dedicated Nestora environment. Access to community information is limited based on permissions, roles, and configuration established by the applicable HOA, community association, or property management company.

Community Data

Resident, guest, vehicle, amenity, event, and community records submitted through Nestora remain owned or controlled by the applicable HOA, community association, property owner, or authorized property management company. Ingress Technology processes such information solely to provide, maintain, secure, and support the Services.

Acceptable Use

You may not access unauthorized information, interfere with system security, attempt to bypass access controls, reverse engineer the Services, upload malicious software, use automated scraping tools, impersonate another person, or use the Services for unlawful, abusive, fraudulent, or harmful purposes.

Mobile App Permissions

The Nestora mobile application may request permissions such as camera access, notifications, or device storage access. These permissions are used only for application functionality, such as scanning driver's licenses, scanning QR codes, receiving community notifications, or uploading images and documents.

Third-Party Services

The Services may integrate with third-party hosting, authentication, communications, analytics, storage, or support providers. Ingress Technology is not responsible for third-party services outside its reasonable control.

Suspension or Termination

Ingress Technology or the applicable community administrator may suspend or terminate access to the Services for violation of these Terms, security concerns, nonpayment by the applicable customer, legal compliance, or other operational reasons.

Intellectual Property

The Services, software, designs, trademarks, logos, interfaces, workflows, and other materials provided by Ingress Technology are owned by Ingress Technology or its licensors. No rights are granted except as expressly stated in these Terms or an applicable written agreement.

Disclaimers

The Services are provided "as is" and "as available." Ingress Technology disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where prohibited by law.

Limitation of Liability

To the maximum extent permitted by law, Ingress Technology shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Ingress Technology's total liability for claims arising from or related to the Services shall not exceed the amount paid to Ingress Technology for the Services during the twelve (12) months before the claim.

Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the applicable Nestora website or application. Continued use of the Services after updates become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
